At Fertiligent AI, we are committed to protecting the privacy and security of your personal and health information. This Privacy Policy explains how we collect, use, and safeguard your data in compliance with global data protection laws, including:

By using our website, platform, and services, you agree to the practices described below.

1. Information We Collect

We may collect and process:

Personal Information: Name, email, phone number, account credentials.
Health Information (PHI/PII): Fertility-related or medical data, collected only with explicit consent and handled in compliance with HIPAA/PIPEDA/GDPR.
Technical Data: IP address, browser type, operating system, device identifiers, and usage patterns.
Cookies & Tracking Data: Session data, preferences, and analytics to improve user experience.

We process personal data under the following lawful bases:

Consent – when you agree to share data (e.g., patient-facing app).
Contractual necessity – to provide services you or your clinic request.
Legal obligation – to comply with healthcare or data protection laws.
Legitimate interest – for research, product improvement, and service delivery (balanced with your rights).

3. How We Use Information

Delivering and improving our fertility AI solutions.
Supporting clinics with workflow automation, compliance, and insights.
Assisting patients through empathetic AI-driven guidance.
Communicating updates, responding to inquiries, and providing support.
Meeting legal, regulatory, and audit obligations.

We do not sell or rent your personal data. We may share data only:

With clinics, healthcare professionals, or authorized caregivers, when you provide explicit consent.
With service providers under strict confidentiality and data protection agreements.
As required by law, court order, or government request.
In anonymized or aggregated form, for research and product development.

5. Data Security

We use industry-leading safeguards including:

6. Data Retention

Personal and health data is retained only as long as necessary to provide services, meet clinical requirements, or comply with law.
Once no longer needed, data is securely deleted or anonymized.

7. The Interactive Demo

Our website offers an interactive demo of the Fertiligent platform. Two different things happen there, and they are kept and deleted differently.

Requesting access. When you give us your name, work email, clinic and role to unlock the walkthrough videos, we treat that as a business contact and retain it, so that we can follow up with you. It is handled under sections 3, 4 and 6 above, and you can ask us to delete it at any time using the contact details in section 12.
Using the demo. If you create an account inside the demo itself, that account and everything you do with it (the account and its credentials, the conversations you view or create, and the sign-in, session and activity records associated with them) are deleted automatically within about a week. Nothing you do inside the demo is retained beyond that window.

The demo contains synthetic data only. Every patient, clinician, appointment and message in it is invented for demonstration, and the clinic it portrays, "Demo Fertility Centre", does not exist. It is a demonstration environment, not a clinical system: please do not enter real patient information, real health information, or any other confidential data into it. Information you enter there is not covered by the clinical safeguards described in section 5, and it will be deleted within the same window whether or not you intended it to be.

8. Your Rights

Depending on your location, you may have the right to:

Access and request a copy of your personal data.
Correct or delete inaccurate or outdated data.
Restrict or object to certain processing activities.
Withdraw consent at any time (without affecting prior lawful processing).
Request data portability (GDPR).
File a complaint with your local data protection authority.

9. International Data Transfers

Data may be transferred across jurisdictions where we or our service providers operate. We implement safeguards such as:

Standard Contractual Clauses (SCCs) under GDPR.
HIPAA Business Associate Agreements (BAAs) in the US.
PIPEDA-compliant contractual safeguards in Canada.

10. Children’s Privacy

Our services are not directed to children under 18 years old. We do not knowingly collect information from minors without verifiable parental/guardian consent.

11. Updates to This Policy

We may update this Privacy Policy from time to time. All updates will be posted here with a new Effective Date.

If you subscribe to our newsletter, we collect your email address and, where you have accepted analytics cookies, the page you subscribed from and the campaign that brought you to the site. We use it to send you occasional email about our products and fertility care, never more than once a month, and for nothing else.

Consent. Subscribing is your express consent under Canada’s anti-spam legislation (CASL). We do not pre-tick anything and we do not add addresses from other forms.
Processors. Submissions are stored by Netlify and copied to HubSpot, which sends the email. Neither is permitted to use your address for its own purposes.
Unsubscribe. Every email carries an unsubscribe link, and it works immediately. You can also write to the address below and we will remove you.
Retention. We keep your address for as long as you are subscribed, and delete it when you unsubscribe or ask.
No selling, no sharing. The list is never sold, rented or shared.
